Whitbread plc t/a Thresher v Gullyes (EAT/478/92)

An employee who resigned from a managerial position because her employer gave her insufficient support was unfairly constructively dismissed.

Case facts

An employee resigned from a managerial position because her employer gave her insufficient support.

Conclusion for me

In failing to provide the support and resources necessary to do the job, the employer was guilty of a repudiatory breach of an implied contractual term that it would not prevent the employee from carrying out her part of her employment contract, or would not frustrate her attempt to perform that contract. She was constructively dismissed.
